The Congress of South African Trade Unions (COSATU) Gauteng expresses deep concern and condemnation over non-compliance by the employer and owner of Babel Restaurant in Menlyn, Tshwane.
This matter was brought to our attention by the video circulated on the social media platforms, where an employee raised challenges they were facing at the restaurant. This level of exploitation is barbaric and a violation of labour laws of this country.
Further to that, employees having to buy their own uniform and equipment, and the lack of basic salary presents a huge challenge, but what is worse is workers sign no contract of employment, which undermines their rights and is frankly disgusting.
COSATU Gauteng applauds the employee for speaking out and exposing this unscrupulous employer, and we urge other workers to come forward with information regarding employers who undermine the conditions of employment and their rights in the process. The gains achieved by workers for workers must remain protected and respected.
The Federation strongly condemns the attitude displayed by the employer and urges the Department of Employment and Labour to conduct inspections of restaurants to make sure that employers comply with the laws and regulations of the country including the Occupational Health and Safety Act, Basic Conditions of Employment Act, Labour Relations Act and other labour laws achieved through the blood and sweat of workers.
COSATU Gauteng is committed to fostering a just and equitable working environment for all, it is for that reason that the campaign for Decent Work remains relevant and important, reminding all stake holders, including the employers that no one is above the law, they all need to abide by the law, and all employers contravening the law should face the full might of the law.
COSATU will work with its affiliates organising the hospitality sector, to hold a picket, and engage with the Department of Employment and Labour as well as management of Badel Restaurant.
