The Congress of South African Trade Unions (COSATU) has recently launched a new call center to provide much-needed assistance to workers facing labour-related challenges. This dedicated resource aims to offer support, information, and guidance to both members of COSATU-affiliated unions and unorganized workers, ensuring that they have a place to turn for help with workplace issues.

NEHAWU WELCOMES LABOUR COURT CONTEMPT OF COURT ORDER AGAINST THE DIRECTOR-GENERAL OF DALRRD

The National Education, Health and Allied Workers’ Union [NEHAWU] welcomes the Labour Court contempt of court order against the Director-General of the Department of Agriculture, Land Reform and Rural Development [DALRRD] for failing to implement the order in terms of a certified arbitration award. The order was handed down at the Labour Court today, the 11th December 2024.

As NEHAWU, we approached the Labour Court after the Department of Agriculture, Land Reform and Rural Development failed to adhere to the Labour Court judgement that ordered the department to translate our member in terms of the provisions of Resolution 3 of 2008 under the workstream of Professional Surveyor as Chief Professional Surveyor, retrospectively from 1 July 2009. This was meant to be done within 30 days from the date of the arbitration award.

Immediately after arbitration award, we informed the department to comply with the order, however this fell on deaf ears with DALRRD contending that a decision was taken to launch a review application challenging the award, and therefore won’t implement the order.

This was a clear and deliberate breach of the arbitration award and as such, we decided to approach the Court for a contempt order which was granted by court today.

The Labour Court determined the Director-General and the Department are guilty of contempt of court. Furthermore, they were directed to pay a fine in the mount of R100 000,00 within fourteen (14) calendar days of this order, which fine is suspended on condition that they comply with the terms of the certified award on or before the expiry of the 14 days.

As NEHAWU, we call on the [DALRRD] to respect and adhere to the Labour Court order. 

Lastly, the union shall continue do everything at its disposal to enforce the implementation of the Labour Court Order in terms of the certified arbitration award.
